How to File an Ethics Complaint with the Flagler County Association of Realtors®

The Flagler County Association of Realtors® (FCAR) is committed to upholding the highest standards of professionalism and ethics in real estate. If you believe a Realtor® has violated the National Association of Realtors® Code of Ethics, you can file an ethics complaint with FCAR. Below are the steps to submit your complaint:

  1. Review the Code of Ethics
    Before filing a complaint, it is important to review the National Association of Realtors® Code of Ethics to ensure the behavior may have been violated. The Code sets forth principles and standards regarding professional conduct and duties to clients, the public, and fellow Realtors®.
  2. Complete the Complaint Form
    To begin, you must fill out the Ethics Complaint Form, which can be obtained from FCAR. The form asks for basic details, including your name, contact information, and a description of the alleged unethical conduct. You will need to clearly state how the actions of the Realtor® violated the Code of Ethics.
  3. Submit the Complaint
    Submit your completed complaint form to the FCAR office. You can mail it, deliver it in person, or email it to the contact details provided on the form.
  4. Investigation Process
    Once the complaint is received, FCAR will review it to ensure it meets the criteria for a valid ethics complaint. If the complaint is accepted, it will be forwarded to a Professional Standards Committee for further investigation.
  5. Hearing and Resolution
    If necessary, a hearing will be scheduled, at which both the complainant and the respondent (the Realtor® accused of unethical behavior) will present their sides. The committee will review the evidence and determine if a violation occurred. If a violation is found, disciplinary action may be taken, ranging from a letter of reprimand to suspension or expulsion from the association.
  6. Appeals Process
    If either party disagrees with the outcome, an appeal can be filed following the established procedures.

Important Considerations:

Ethics complaints should be based on violations of the Code of Ethics and not personal grievances or contract disputes.
The complaint must be filed within a reasonable timeframe, typically within 180 days of the alleged incident.
